Patent:

A patent is an exclusive right awarded for an invention, a product, or a technique that provides a novelty of doing something new or innovating a new technological solution. In return for this privilege, the patent holder publishes technical details about the invention in the patent document.

 

 Patent protection implies that the innovation cannot be commercially manufactured, utilized, distributed, or sold without the approval of the patent owner. For the duration of the patent's protection, the patent owner has the authority to decide who may or may not utilize the patented innovation. The patent owner may provide permission to or license third parties to use the creation on mutually agreed-upon terms.

 

The owner can also have the right to sell their invention to another person, who becomes the patent's new owner. When a patent expires, the protection ends, innovation is then commercially exploitable by others.

 

In exchange for patent protection, all patent holders must publicly disclose information about their innovation to contribute to the global body of technical knowledge. Who can File a Patent -

 

An invention can be filed by any of the following individuals, either alone or in collaboration with another individual:

  1. The authentic and original creator

  2. An assignor of the true and first inventor

  3. The assignee of the dead actual and original inventor's representative

 

A "Person" is defined in the Patent Act as any natural person, firm, association, group of persons, or government entity, whether incorporated or not.

  1. In the event of a sole proprietorship, the application shall be lodged in the name of the sole proprietors.                                                  

  2. In the case of a partnership, all the names of personally liable members must be provided in the patent application form.

 

An assignor can also be a natural person or an entity other than a legal person, such as a registered business, an LLP, a Section 8 corporation, a university, or the Government. The applicant must reveal the true and first inventor's name, address, and country.

 

Patentable inventions -

 

To qualify as patentable subject matter, innovation must fulfill the following requirements:

 

  • It should be unique.

  • It must include an initial step or be non-obvious.

  • It should be suitable for industrial use.

  • The invention must not come under the preview of Sections 3 and 4 of the Patents Act of 1970.

 

The general process for acquiring a patent is as follows:

 

  • Filing of a patent application

  • Publication after 18 months

  • Any individual may object to or represent the grant before it is granted.

  • Request for Examination

  • Examination: Grant or Refusal

  • Publication of Patent Grant

  • Post Grant Opposition to Patent Grant

  • Controller Decision

 

Patent duration –

 A patent has a duration of 20 years from the date of application, subject to the payment of an annual fee.
